1. About Esteti

Esteti is a software platform designed to help beauty, aesthetic, and wellness clinics manage customer enquiries and communications, including those received via Instagram, Facebook, and WhatsApp Business.

We are not affiliated with, endorsed by, or officially connected to Meta Platforms, Inc., Instagram, WhatsApp, or Facebook.

Use of Instagram, WhatsApp or Facebook via Esteti is subject to their independent terms and policies.

2. Eligibility

To use Esteti, you must:

• Be at least 18 years old
• Be authorised to act on behalf of your business
• Use the Service for lawful and compliant purposes
• Follow all applicable laws and Meta platform policies

We may restrict, suspend, or terminate accounts that do not meet these conditions.

3. Account Registration

You must provide accurate and complete information when creating an Esteti account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

If you believe your account has been compromised, you must notify us promptly.

4. Subscription, Pricing & Billing

Esteti is offered as a subscription-based service.

By subscribing, you agree to:

• Pay all applicable subscription fees
• Allow recurring billing via your chosen payment method
• Keep payment details valid and up to date

We reserve the right to update pricing with reasonable notice.

4.1 Refunds

All subscription charges are non-refundable, except where required by law.

5. Use of Instagram, Facebook & WhatsApp

Some features require connecting your:

• Instagram Business Account
• Facebook Page
• WhatsApp Business API number

By connecting these accounts, you confirm that:

• You have the rights and permissions to use them
• Esteti may access the data necessary to provide functionality
• Esteti will not post or message without your instruction
• You will comply with Meta/WhatsApp/Facebook policies
• You are responsible for message content, frequency, and compliance

We may remove or limit integrations that cause risk, violate policies, or affect platform safety.

6. Permitted Use

You agree not to use Esteti to:

• Send spam, bulk unsolicited messages, or automated outreach
• Harass, threaten, mislead, or deceive customers
• Violate Instagram, Facebook, or WhatsApp terms
• Interfere with or bypass API limits or platform restrictions
• Reverse-engineer or replicate the Service
• Engage in illegal, harmful, or abusive activity

We may suspend or terminate access for misuse or policy violations.

7. Data & Privacy

Your data is processed according to our Privacy Policy.

By using Esteti, you grant permission for us to:

• Store and process your message history and customer information
• Synchronise data between Esteti and Meta platforms solely for functionality
• Retain data as required to provide core features and comply with law

We do not sell or monetise customer data.

You retain full ownership of the content and customer data you submit.

8. Service Availability

We aim to deliver reliable service but do not guarantee uninterrupted access.

Our service may be affected by:

• Instagram, Facebook, or WhatsApp platform outages
• API limitations or rate restrictions
• Required updates to comply with external policies
• Maintenance or improvements

We are not responsible for third-party platform issues or actions.

9. Intellectual Property

All intellectual property related to Esteti — including software, designs, and branding — is owned by us and protected under applicable law.

You may not copy, redistribute, resell, or modify any part of the Service.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided “as is” and “as available”
• We disclaim all indirect, consequential, or incidental damages
• Our total liability will not exceed the fees you paid in the preceding 12 months

We are not responsible for:

• Actions taken by Instagram, Facebook, or WhatsApp (e.g., account restrictions, message limitations)
• Loss of access due to platform outages or policy changes
• Errors caused by incorrect setup or misconfiguration

11. Termination

You may cancel your subscription at any time.

We may suspend or terminate your account if:

• You violate these Terms
• Your subscription payment fails
• Required permissions are removed from Meta/Facebook/WhatsApp
• Continued use creates legal, compliance, or security risks

Upon termination, access may be revoked immediately, but you may request applicable data exports.

12. Changes to These Terms

We may update these Terms periodically.

If changes are significant, we will notify you via email or within the Esteti dashboard.

Continued use of the Service after changes indicates acceptance.

13. Governing Law

These Terms are governed by the laws of Spain.

Any disputes shall be resolved exclusively in Spanish courts.
